The day before Thanksgiving, the U.S. government continued its war on American children

when Chief U.S. District Judge Bernard A. Friedman threw out a lawsuit filed by the National

Education Association and school districts in three states, geared towards blocking Bush's Draconian

"No Child Left Behind" debacle.

The NEA, a union with 2.7 million members, filed the suit along with districts in Michigan, Vermont

and Texas (oops) as well as 10 NEA chapters in Connecticut, Illinois, Indiana, New Hampshire, Ohio,

Pennsylvania and Utah, seeking to define NCLB as a classic Bush bait-and-switch "unfunded mandate."

The suit stated that, since the federal government wasn't paying for implementation of the plan, schools

weren't required to have to comply with it.

The judge kicked them in the teeth, opining that "Congress has appropriated significant funding" and has

the clout to require states to do what they say in exchange for the moolah. (Sort of the educational version

of "The Abramoff Principle.")

The fact is: the law is anti-middle class and anti-poor. It also knocks public education on its ass, with

Bush seeing education as a way for teaching kids discipline through punishment and fear of failure as

opposed to allowing kids to blossom scholastically, artistically and culturally. In short, it reduces children

to droning robots parroting facts without understanding them and encourages teachers to just "teach the test."

The headline of this New York Sun article by Eli Lake on the progress of the case 

[.pdf] against Lawrence A. Franklin, a Pentagon analyst accused of handing over 

sensitive information to Israel , has got to take the cake for sheer gall: "Pentagon 

Analyst In Israel Spy Case Is Called a 'Patriot'"!

You can't make this stuff up.

Franklin was recently arrested and charged with revealing top secret information to 

two employees of the American Israel Public Affairs Committee (AIPAC), who then 

informed Israeli officials. It turns out that the person calling Franklin a "patriot" is 

none other than his lawyer, the famed Plato Cacheris, whose clients have included 

Russian spy Robert Hanssen, Cuban spy Ana Belen Montes, and Monica Lewinsky

but even so: Come on!

Yeah, he's a "patriot" all right – but on behalf of which country? Surely not the United 

States of America .

Rep. John Conyers (D-MI) is drafting a letter to Defense Secretary —

Donald Rumsfeld seeking answers after a report in the Sunday London Times 

revealed the U.S. and Britain may have sought to goad Iraq into war even 

as UN negotiations were ongoing, RAW STORY has learned.

A staffer said the congressman called the latest revelations "the smoking 

bullet in the smoking gun."

Conyers' early draft, leaked to RAW STORY, raises a battery of questions 

surrounding the Administration's plans for the Iraq war.

"If true, these assertions indicate that not only had our nation secretly and 

perhaps illegally agreed to go to war by the summer of 2002, but that we

compelling evidence that the President of the United States has been

under Article II, Section 4 of the United States Constitution: “The

these Nukes. Bush would have made this a topic of discussion when he went to

The President is a War Criminal

Iraq didn’t use cluster bombs. The U.S. used cluster bombs in every conflict. 

Iraq didn’t use nuclear weapons. The U.S. used depleted uranium munitions 

in every comflict.

Nor did Iraq use depleted uranium in its conventional weapons - which can cause 

long term medical problems, all types of cancer, and kill innocent civilians who 

come in contact with it. The U.S. used napalm in Vietnam. It may have used 

nerve gas in Cambodia.

The George Bush gang of warmongers pulled out all the stops to convince the 

world that war was necessary and the only choice, Iraq even agreed to U2 overflights, 

including French, and Russian surveillance aircraft. But it didn’t make any difference 

because U.S. forces were already deployed and prepared to attack.

This president is a war criminal. His intention from the very beginning of his presidency 

was to attack Iraq. The posturing was part of the way this preparation for war was orchestrated.

The prospect of the smooth transition of executive power from one leader 

to the next seems more and more implausible. The dubious presidential 

election of 2004 has created a feeling of uneasiness among the people who

Christopher Hitchens has dismissed the balloting as just another big scam. 

There's simply no way to account for the statistical anomalies that exist 

between the final vote count and the exit polls. The election was clearly 

rigged (with the help of the Republican-owned voting machinery) and the 

media papered it over with some nonsense about Christian zealots coming 

down from the mountains to vote in their first election. (a myth that was 

disproved months later) It's just another victory for Karl Rove and the public 

relations firms that run the country.

Rumsfeld's Press Crackdown

Secretary of Defense Donald Rumsfeld has launched the latest attack 

in the administration's war on a free and independent media. The Pentagon 

is requiring reporters covering the court-martial of U.S. Army Sgt. Hasan 

Akbar at Fort Bragg , N.C. , to "sign agreements that limit their ability to 

perform their jobs under the First Amendment of the U.S. Constitution." 

In order to gain access to the proceeding, reporters must "pledge to not 

interview soldiers at Fort Bragg about the case or ask legal advisors in the 

media room to speculate on the outcome."

If you've got something to hide in Washington, the best place to bury it is in the federal budget. The spending plan that President Bush submitted to Congress this year contains 2,000 pages that outline funding to safeguard the environment, protect workers from injury and death, crack down on securities fraud and ensure the safety of prescription drugs. But almost unnoticed in the budget, tucked away in a single paragraph, is a provision that could make every one of those protections a thing of the past.

The proposal, spelled out in three short sentences, would give the president the power to appoint an eight-member panel called the "Sunset Commission," which would systematically review federal programs every ten years and decide whether they should be eliminated. Any programs that are not "producing results," in the eyes of the commission, would "automatically terminate unless the Congress took action to continue them."
